CHICAGO - A proposal that would let students in Delaware as young as 5 choose their own race and gender-identity – without approval from their parents – has sparked a bitter battle.
Sound absurd to ignore basic science and DNA evidence?
First Delaware. Illinois could be next. Already – as of January 1, 2018 – Illinois allows residents to change their gender identities on their birth certificates without undergoing anatomical surgeries.
Illinois activists were delighted that GOP Governor Rauner signed the measure into law last fall.
"It's basic common sense that a person's gender should be recognized and respected, whether or not that person has had any particular kind of surgery. Isn't it equally obvious that the government should not be in the business of requiring people to have surgery that they may not want or need in order to secure a birth certificate that accurately reflects who they are?" said John Knight, director of the ACLU of Illinois' LGBT and HIV Project.

On one side are parents who say they want a more welcoming climate for their transgender or non-binary children. On the other side are parents who say the proposal infringes on their basic parental rights.
Under Regulation 225, schools would be required to provide access to facilities and activities that are consistent with a student's gender identity—regardless of the child's sex at birth. That includes bathrooms, locker rooms, team sports and adhering to the child's preferred name. Under the proposal, students could also choose their own race.
