Second state rep files lawsuit against Gov Pritzker “on behalf of all IL citizens similarly situated”

ROCKFORD – A second Illinois state rep filed lawsuit with the 17th Judicial Circuit Court in Winnebago County Wednesday morning concerning Gov Pritzker's emergency orders to shutdown the state of Illinois during the COVID-19 crisis.

One phrase in particular stands out at the top of the suit, along with "John Cabello, in his individual capacity," is "and on behalf of all citizens of the state of Illinois similarly situated," making State Rep. John Cabello's complaint a "class-action" lawsuit.

One of the involved attorneys, Austin Scott Davies, told Illinois Review not only is the Cabello suit different from State Rep. Darren Bailey's as being a class action lawsuit, it also includes more counts.

Earlier this week, a Clay County judge ruled on State Rep. Darren Bailey's behalf requesting a temporary restraining order concerning Pritzker's continuing executive order which, Bailey argued, surpasses the Illinois statute limiting a governor's emergency powers to 30 days. The court has given the governor's office until next week to respond. 

In the meantime, Governor Pritzker has promised to sign into effect another 30-day emergency "shelter-in-place" order for the state of Illinois on Thursday of this week. The order is intended to extend the orders until May 30th.
