Owning a gun could be reason to lose 2nd Amendment rights with proposed bill

SPRINGFIELD – The Illinois House could vote on legislation next week that could remove Second Amendment rights if a person simply possesses a gun, and someone feels threatened by it, the Illinois State Rifle Association says.

"HB 3160 would allow an individual’s family members, law enforcement or roommates to petition the court for an ex parte restraining order if they consider the individual to be a danger to themselves or others simply because the individual owns, possesses or purchases a firearm," the ISRA says in an alert to its members.  

The proposed "Lethal Violence Order of Protection Act" requires a petition to be filed with the court alleging that "the respondent poses a danger of causing personal injury to himself, herself, or another by having in his or her custody or control, owning, purchasing, possessing, or receiving a firearm."

If enacted, the law would require the gun owner to surrender to law enforcement FOID cards, concealed carry licenses, as well as legally-owned firearms. 

"This legislation is ripe for abuse by individuals that disagree with the Second Amendment, and the mere insinuation that gun ownership makes you a danger to yourself or others is offensive and insulting," the ISRA says.

Thirty-two Democrats have signed on as co-sponsors to the legislation, including Rep. Kathleen Willis – Luis Arroyo, Kelly M. Cassidy, Ann M. Williams, Christian L. Mitchell, Anna Moeller, Martin J. Moylan, Deb Conroy, Pamela Reaves-Harris, Esther Golar, Daniel J. Burke,Robyn Gabel, Cynthia Soto, Emanuel Chris Welch, William Davis, Scott Drury, Laura Fine, Jaime M. Andrade, Jr., Marcus C. Evans, Jr., Michelle Mussman, Elaine Nekritz, Elizabeth Hernandez, Sonya M. Harper, Robert Martwick, Camille Y. Lilly, Silvana Tabares, Will Guzzardi, Edward J. Acevedo,Sara Feigenholtz, Kelly M. Burke, Barbara Flynn Currie and Litesa E. Wallace.
